This Personal Data and Cookies Policy (the Policy) sets out what Source EV UK Ltd, registered in England under company number 14401537 (we, us or our), collects from its customers in relation to the SourceConnect mobile application and https://www.source-charging.com website, together hereinafter known as the “Apps”.
This Policy is to inform you how we will collect, use, share or otherwise process your personal data. This Policy will also cover any of our services that are accessible through the Apps (Services) unless such Services state that a separate or additional privacy notice applies to a particular Service, in which case only that privacy notice applies.
It will also set out your rights you are entitled to exercise regarding the processing of your data; it also describes the measures we take to protect your data. We encourage you to read this document carefully to understand how we process your data.
The Apps are not intended for children, and we do not knowingly collect data relating to children.

Source EV UK Ltd is the controller responsible for the Apps in the UK.

1. The personal data we collect about you

  1. Identity and Contact data: full name, postal address, phone number;
  2. Profile data: your email address, username and password
  3. Transaction data: credit/debit card number, expiry date, history of your payments and details of any refunds;
  4. Device data: the type of device you use, mobile network information and IP address;
  5. Usage data: connection logs, analytics, and any error or debugging information;
  6. Location data: your current location as disclosed by GPS technology, WiFi connections and/or your IP address. This will also be one of the permissions asked for by the Apps in order to provide the location of the charging points and other relevant part of our Services;
  7. Security data: information we collect about your use of the Apps or our Services in order to ensure your and our other users' safety and security, Usage data, Cookies data and the information provided to us by our payment processing provider;
  8. Cookies data: the information collected through the cookies and similar technologies listed in the “Cookie management” section set out below;
  9. Direct Marketing data: your direct marketing preferences, consents for receiving direct marketing from us or our third parties and the history of the direct marketing communications we have sent to you;
  10. Personalisation data: Cookies data, Transaction data, Usage data, Location data, and the preferences we have inferred you have and use to personalise the Apps and Services, being the preferences noted on your account;

3. Purpose of processing, legal basis, storage period and types of data collected

When using the Apps, you may be required to provide us with your personal data. We will only process your data where we have a legal basis to do so. Most commonly we will use your personal data in the following circumstances:
  • Performance of a contract with you: where we need to perform the contract, we are about to enter into or have entered into with you;
  • Legitimate interests: where necessary for our legitimate interests or those of a third party to whom we may provide your personal data in connection with operating the Apps or our Services provided such interests are not overridden by your own rights and interests;
  • Legal obligation: where necessary for compliance with an obligation that applies to us by applicable law
  • Consent: we rely on consent only where we have obtained your active agreement to use your personal data for a specified purpose.

Your personal data will not be processed later in a way that is incompatible with the purposes described in this Policy.
If you close your account with us, we will delete your personal data securely.

4. Data retention

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.
To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.
In some circumstances you can ask us to delete your data: see paragraph 13 below for further information.
In some circumstances we will anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

5. Automated decision making and profiling

Whilst we undertake automated decision making and profiling of your personal data to recommend the most appropriate charge tariff to you (as set out above), these decisions do not produce any legal effects concerning you and nor do they have similarly significant effects on you. If you require any further information on this processing, please contact us using the details set out in paragraph 13.

6. Data recipient

We may share your personal data with the following third parties:
  • other companies within our corporate group for the purpose of them providing services to us;
  • our service providers, customer relationship management providers (including their subcontractors) that help us to manage our relationship with you, provide our services to you and operate our business (such as our payment service providers, our App and hosting service providers, mobile network providers, our IT service providers);
  • professional advisors (accountants, auditors, lawyers, tax advisers or business consultants) to help us operate and manage our business;
  • debt collection agencies in order to recover any outstanding debts owed to us;
  • marketing and promotional materials from third parties where you have expressly subscribed to receive marketing from
  • regulators, law enforcement, public authorities or other third parties in order for us to comply with any legal orders, legal or regulatory requirements and any investigation.

7. Data transfers

Where data is transferred to a country outside the UK, the process will be performed in accordance with applicable legislation and in such a way as to ensure appropriate protection of your personal data.
When we transfer your personal data to certain countries outside of the UK:
  • If there are UK adequacy regulations in respect of that country (France, Germany), we will rely on those to undertake our transfer; or
  • In the case of transfers of personal data to a third party in the United States, we may rely on that third party’s certification to the EU-US Data Privacy Framework and the UK extension to the Framework to transfer your personal data.
In other cases, we are required to put in place an appropriate transfer mechanism such as the International Data Transfer Agreement. This will ensure your personal data receives the same protection it would receive if it was in the UK. 8. Data security and privacy

The data controller takes appropriate measures to protect the security and confidentiality of your personal data, in particular to prevent it from being distorted, compromised or disclosed to unauthorised third parties. Any data that is stored outside the UK will have sufficient security measures. We have put in place procedures to detect and respond to personal data breaches and notify you and any applicable regulator when we are legally required to do so.

9. Failure to provide personal data

If you don’t provide us with certain information when requested, we may not be able to perform our obligations to you or your organisation, or we may be prevented from complying with our legal obligations.

10. Cookie management

A cookie or tracker is a file used to log information about how you browse the Apps to improve your browsing experience. We use the following types of cookies:
  • Strictly necessary cookies. These are cookies that are required for the operation of our Apps. These essential cookies are always enabled because our Apps won’t work properly without them. They include, for example, cookies that enable you to log into secure areas of our Apps or make use of e-billing services. You can switch off these cookies in your settings, but you may then not be able to access all or parts of our Apps
  • Analytical or performance cookies. These allow us to recognise and count the number of visitors and to see how visitors move around our Apps when they are using it. This helps us to improve the way our Apps work, for example, by ensuring that users are finding what they are looking for easily.
  • Functionality cookies. These are used to recognise you when you return to our Apps. This enables us to personalise our content for you, greet you by name and remember your preferences (for example, your choice of language or region).
  • Targeting cookies. These cookies record your visit to our Apps, the pages you have visited and the links you have followed. We will use this information to make our Apps and the advertising displayed on it more relevant to your interests.

Some of them belong to the publisher of the Apps (first party) and certain third parties. We have no control over the cookies from these third parties.
